The “Reply in Opposition to Israel’s Response to South Africa’s Application” apprises the ICJ that Israel is attempting to intimidate the ICJ judges into deciding this case based on politics rather than applying the law to the facts of the case. On January 4, 2024, the Israeli Foreign Ministry sent a cable instructing its embassies to pressure politicians and diplomats in their host countries to make statements opposing South Africa’s case at the ICJ. The cable states that Israel’s “strategic goal” is for the court to reject the request for an injunction, refrain from determining that Israel is committing genocide in Gaza, and recognize that the Israeli military is operating in the Strip according to international law.
The reply further points out that it is strongly alleged that Israeli leaders let their own civilians die on October 7, 2023 so they could push forward their geopolitical agenda. The Zionist Nation-State of Israel’s geopolitical agenda is fourfold: maximize political power, maximize territorial expansion beyond the borders of Palestine, exploit oil & gas fields in illegally occupied Palestinian territories, and commence construction of the Ben Gurion Canal.
General Michael Flynn, the former Director of the United States Defense Intelligence Agency, states that “there was a decision made to have a security stand down, on the 7th of October, for 7 hours.” Given that the Israel-Gaza border is the most secure border in the world and Israel/U.S. have the best intelligence in the world, it appears that Israel and the Israel Defense Forces (“IDF”) allowed the Hamas attack to happen, so Israel could justify its genocide/ethnic cleansing campaign in Palestine, and the forced relocation of the Palestinian population.
The reply, which explains that it is crucial to distinguish between Judaism and Zionism, provides historical political context, from November 2, 1917 to May 14, 1948, for the creation of the Zionist Nation-State of Israel. In essence, in exchange for its political and financial support, the British government promised the Zionist movement a country where Palestinian Arab natives made up more than 90 percent of the population. The reply, which includes a 3-part legal analysis of the crisis in Palestine, points out that there is only one way to secure a peaceful and dignified future between the Jordan River and the Mediterranean Sea, and it is by ensuring recognition and respect for equal rights, dignity and freedom of the Palestinians. In order to secure this peaceful and dignified future, a 14-point comprehensive solution to the genocide campaign in Gaza is recommended.
In conclusion, the reply sets forth the following observations:
(a) Israel’s attempt to intimidate the ICJ by politicizing this case demonstrates not only Israel’s contempt for this honorable court but also a complete lack of respect for the rule of law. The ICJ must send a strong message to Israel that the international community will not tolerate its actions and seeks to hold it accountable. Failure of the ICJ to do so may result in a substantial and widespread lowering of public confidence in the integrity and impartiality of international law and this honorable court.
(b) Given that the Balfour Declaration and the British Mandate were drafted by and for Zionists without any consideration for the rights of the Palestinians, the ongoing annexation of Palestinian land, the acts of genocide, ethnic cleansing, and apartheid which are being committed against the Palestinian people by the Zionist Nation-State of Israel, a very strong legal argument could be made that the Zionist Nation-State of Israel is not now nor has it ever been an entity worthy of recognition by the international community. It should be dissolved.
(c) The ongoing genocide campaign being committed against the Palestinian people by the Zionist Nation-State of Israel and the U.S. must be immediately stopped; the entire State of Palestine must be returned to the Palestinians; the Zionist Nation-State of Israel must be dissolved; the cancerous political ideology of Zionism must be eliminated; and Jews, Muslims, and Christians must again live and work together in peace as brothers and sisters in one democratic State of Palestine.
If history is any indication, neither the Zionist Nation-State of Israel nor the individuals responsible for the genocide campaign being undertaken in Gaza will ever be held fully accountable by the ICJ. Nonetheless, the reply urges the ICJ to immediately issue an injunction to stop Israel’s ongoing slaughter of innocent Palestinian men, women, and children in Gaza.
